| dc.description.abstract | Este estudo investiga criticamente a relação entre o sistema penal e a luta feminista contra a violência de gênero, à luz da Teoria da Reprodução Social, partindo do seguinte problema de pesquisa: a forma jurídica, em sua expressão penalizadora, pode ser um instrumento eficaz na superação da violência contra a mulher ou reforça as relações de opressão? A hipótese levantada é que a aposta no recrudescimento penal como mecanismo de enfrentamento à violência contra a mulher não apenas se mostra ineficaz, mas também contribui para a reprodução das desigualdades estruturais de gênero e classe e, por isso, se mostra como campo ilegítimo de batalha feminista. Para tanto, parte-se de uma análise do direito enquanto forma social vinculada ao modo de produção capitalista, demonstrando seu papel na manutenção da ordem e na reprodução da opressão de gênero. Examina-se, ainda, a Teoria da Reprodução Social como ferramenta teórica fundamental para compreender as relações entre gênero, classe e exploração, evidenciando como o trabalho reprodutivo feminino é central para a perpetuação do sistema capitalista. Por fim, a pesquisa aborda criticamente a Lei Maria da Penha, destacando seus limites e contradições, especialmente no que se refere à sua incorporação ao aparato penal. Adota-se uma abordagem metodológica qualitativa, baseada na revisão bibliográfica e análise documental, ancorada no materialismo histórico e na crítica marxista do direito. Conclui-se que a efetiva superação da violência de gênero exige uma transformação estrutural que vá além das respostas penais, priorizando estratégias que enfrentem as bases materiais da opressão feminina. | |
| dc.description.resumo | This study critically investigates the relationship between the penal system and the feminist struggle against gender violence, in the light of the Theory of Social Reproduction, based on the following research problem: can the legal form, in its penalizing expression, be an effective instrument in overcoming violence against women or does it reinforce the relations of oppression? The hypothesis raised is that focusing on increased penalization as a mechanism for dealing with violence against women is not only ineffective, but also contributes to the reproduction of structural gender and class inequalities and is therefore an illegitimate battleground for feminism. In order to do this, we begin with an analysis of law as a social form linked to the capitalist mode of production, demonstrating its role in maintaining order and reproducing gender oppression. It also examines the Theory of Social Reproduction as a fundamental theoretical tool for understanding the relationships between gender, class and exploitation, highlighting how women's reproductive work is central to the perpetuation of the capitalist system. Finally, the research critically addresses the Maria da Penha Law, highlighting its limits and contradictions, especially with regard to its incorporation into the penal apparatus. A qualitative methodological approach is adopted, based on a bibliographical review and documentary analysis, anchored in historical materialism and the Marxist critique of law.
