| dc.description.abstract | A pesquisa realizada está relacionada a tema prevalentemente da área de direito constitucional e tratou dos direitos sociais da pessoa idosa, analisando-os sob o enfoque da sua efetividade. Permitiu estudar os direitos fundamentais da pessoa idosa, compreender como se dá a omissão do Estado quanto à efetivação dos direitos sociais e dar evidência ao estado de vulnerabilidade social gerado por essa omissão, portanto, conhecer a realidade e instigar a pensar meios pelos quais o Estado pode atuar para garantir à pessoa idosa a concretização de fato de seus direitos, confrontando o que está contido na ordem normativa com a realidade vivida pelo cidadão. Pretendeu-se responder ao problema de pesquisa: Qual é o impacto da omissão do Estado em implementar políticas públicas na efetivação dos direitos sociais das pessoas idosas hipossuficientes? Realizou-se a pesquisa por meio do método empírico, consistente na pesquisa documental, que levou ao acesso aos dados do Instituto Brasileiro de Geografia e Estatística – IBGE, aos planos de ação dos municípios paranaenses, vinculados ao Programa da Rede Global de Cidades e Comunidades Amigas dos Idosos, da Organização Mundial da Saúde – OMS e ao Programa Estratégia Brasil Amigo da Pessoa Idosa - EBAPI, bem como pesquisa bibliográfica, com o estudo de artigos científicos que analisaram os dados dessas instituições e outros artigos e livros para formar a base teórica, resultando na conclusão de que a omissão do Estado em face da pessoa idosa ocorre por uma questão cultural que não reconhece os Direitos Humanos deste grupo, que está inserido no mesmo conjunto de grupos vulneráveis como mulheres, pretos, indígenas, homossexuais, que sempre foram subjugados por grupos dominantes, tolhendo os direitos destes grupos por não considerarem sua condição de seres humanos. A pesquisa está adequada ao programa de pós-graduação da Universidade Estadual do Norte do Paraná – UENP, inserida na área de concentração “Teorias da Justiça: Justiça e Exclusão”, alinhada com a linha de pesquisa “Direitos e Vulnerabilidades”. | |
| dc.description.resumo | The research carried out is related to a topic predominantly in the area of constitutional law and deals with the social rights of the elderly, analyzing them from the perspective of their effectiveness. It allowed us to study the fundamental rights of the elderly, to understand how the State fails to enforce social rights and to highlight the state of social vulnerability generated by this omission, therefore, to understand the reality and to encourage us to think about ways in which the State can act to guarantee the elderly the realization of their rights, comparing what is contained in the normative order with the reality experienced by the citizen. The aim was to answer the following research problem: What is the impact of the State's failure to implement public policies on the realization of the social rights of underprivileged elderly people? The research was carried out using the empirical method, consisting of documentary research which led to access to data from the Brazilian Institute of Geography and Statistics – IBGE, to the action plans of the municipalities of Paraná, linked to the Global Network of Age-Friendly Cities and Communities Program, of the World Health Organization - WHO and the Brazil Strategy Program Friendly to the Elderly - EBAPI, as well as bibliographic research, with the study of scientific articles that analyzed data from these institutions and other articles and books to form the theoretical basis, resulting in the conclusion that the State's omission towards the elderly occurs due to a cultural issue that does not recognize the Human Rights of this group, which is included in the same set of vulnerable groups as women, black people, indigenous people, homosexuals, who have always been subjugated by dominant groups, restricting the rights of these groups by not considering their condition as human beings. The research is suitable for the postgraduate program of the State University of Northern Paraná – UENP, inserted in the area of concentration “Theories of Justice: Justice and Exclusion”, aligned with the research line “Rights and Vulnerabilities”. | |
